If a product is listed at an incorrect price because of a typographical, technical, supplier, or other error, we may refuse or cancel the affected order.

If payment has already been collected for an order that we cancel because of a pricing error, the applicable amount will be refunded to the original payment method.

Submitting an order through MommysToyShop.com does not necessarily mean that the order has been accepted or can be fulfilled.

Delivery timeframes are estimates unless expressly stated otherwise.

Delivery dates and courier timeframes are estimates and are not guaranteed unless expressly stated otherwise.

Mommys Toy Shop is not responsible for courier delays or other delays caused by circumstances outside our reasonable control.

10. Discreet Packaging

We understand that discretion is important to our customers.

Orders shipped by Mommys Toy Shop are intended to use plain or discreet external packaging that does not prominently identify the nature of the products inside.

Shipping labels, return addresses, payment descriptors, or courier information may identify MH Pleasures Inc., Mommys Toy Shop, MTS, or another appropriate business descriptor.

11. Payment

Payment methods available through MommysToyShop.com may include major credit cards and other methods displayed at checkout.

Payments are processed through third-party payment service providers, which may include Square or other providers used by MH Pleasures Inc.

Mommys Toy Shop does not store complete payment card numbers on its own servers.

Charges may appear on your statement under MH Pleasures Inc., Mommys Toy Shop, or another descriptor disclosed during checkout.

12. Returns, Exchanges and Hygiene Products

Many products sold by Mommys Toy Shop are intimate or personal-use products.

For health, hygiene, and safety reasons, some products may not be eligible for return or exchange after packaging has been opened or the product has been used.

Returns, exchanges, cancellations, warranties, and refunds are subject to our posted return and refund policies and applicable law.

Nothing in these Terms and Conditions is intended to remove or limit consumer rights or remedies that cannot legally be excluded.

13. Defective, Damaged or Incorrect Products

If you receive a product that is damaged, defective, or incorrect, contact us as soon as reasonably possible.

The sale of a third-party product does not transfer ownership of the manufacturer’s intellectual property to Mommys Toy Shop or the purchaser.

18. Third-Party Websites

MommysToyShop.com may contain links to websites operated by third parties, including PleasurePackages.ca and other external websites.

We are not responsible for the content, privacy practices, security, availability, or terms of third-party websites.

Where you leave MommysToyShop.com and make a purchase through another website, that website’s own terms, policies, and purchasing conditions apply.

19. PleasurePackages.ca

PleasurePackages.ca is another online storefront operated by MH Pleasures Inc.

Although Mommys Toy Shop and Pleasure Packages are operated by the same corporation, they operate as separate storefronts.

Purchases made through PleasurePackages.ca are governed by the policies, shipping arrangements, fulfillment practices, Terms and Conditions, and Privacy Policy published on PleasurePackages.ca.

A product displayed or linked from MommysToyShop.com may therefore be subject to different fulfillment or shipping arrangements if the actual purchase is completed through PleasurePackages.ca.

20. Limitation of Liability

To the extent permitted by applicable law, MH Pleasures Inc. is not liable for indirect, incidental, special, or consequential damages resulting from the improper or unintended use of products or use of the website.

Customers are responsible for using products safely and in accordance with applicable manufacturer instructions and warnings.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

21. Consumer Rights

These Terms and Conditions are intended to operate consistently with applicable Canadian and Alberta consumer-protection laws.

Nothing in these Terms is intended to waive, restrict, or eliminate a consumer right or remedy that cannot legally be waived.

Where these Terms conflict with a mandatory requirement of applicable law, the applicable legal requirement will govern.

22. Governing Law

These Terms and Conditions and your use of MommysToyShop.com are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Any dispute will be subject to the jurisdiction of the courts or tribunals having jurisdiction in Alberta, except where applicable consumer-protection legislation provides otherwise.

23. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.
